Terms of Service

Marktspan is a business software platform for marketplace sellers. It helps teams manage marketplace research, listings, orders, inventory, advertising, invoicing, reporting, and related workflows.

You must provide accurate account, company, billing, and tax information. If you create a workspace for a company, you confirm that you are authorised to bind that company to these terms.

You are responsible for keeping login credentials secure and for activity in your workspace, including activity by invited team members.

When you connect marketplace, advertising, payment, or logistics accounts, you authorise Marktspan to access and process the data needed to provide the service. You remain responsible for your marketplace accounts, listings, prices, tax settings, fulfilment, customer obligations, and compliance with marketplace rules.

Automation features may prepare or execute operational actions only within the permissions you configure. You should review settings, recommendations, and audit logs regularly.

Paid plans are billed through Stripe according to the plan, billing cycle, and price shown at checkout or in your billing settings. Prices are shown excluding VAT unless stated otherwise.

If a free trial is offered, the trial length and conversion conditions are shown before checkout. You can manage or cancel your subscription from billing settings or by contacting billing@marktspan.com.

Cancellation takes effect at the end of the paid billing period unless otherwise stated in your plan. We do not charge hidden cancellation fees. Refunds are handled case by case where required by law or where a billing error occurred.

You must not use Marktspan to:

• break applicable law, marketplace rules, or third-party rights;
• attempt unauthorised access to systems, accounts, or data;
• upload malicious code or interfere with the service;
• misrepresent products, prices, tax treatment, or customer communications;
• resell, copy, or reverse engineer the service except where law permits it.

Our Privacy Policy explains how we process personal data, which service providers we use, and how users can exercise data-protection rights. Where required, we will enter into an appropriate data-processing agreement with business customers.

We aim to keep Marktspan reliable, but the service may be unavailable because of maintenance, incidents, third-party outages, marketplace API limits, or force majeure. We may update features, pricing, and integrations as the product develops.

Support is available through in-app channels or email. Enterprise customers may have additional support terms in a separate agreement.

Marktspan provides operational software and analytics. It does not provide legal, tax, accounting, or financial advice. You should verify tax, compliance, and marketplace decisions with qualified advisors where needed.

To the maximum extent permitted by law, Jooier B.V. is not liable for indirect damages, loss of profits, loss of revenue, loss of data, marketplace penalties, or decisions made based on inaccurate settings, source data, or third-party API data. Our aggregate liability is limited to the fees paid for the service in the three months before the event giving rise to the claim, unless mandatory law requires otherwise.

These terms are governed by Dutch law. Disputes will be submitted to the competent court in The Netherlands, unless mandatory consumer or business-protection rules require a different venue.
